Modifications of Maintenance and Custody Terms
Since your divorce, circumstances have probably changed. You have a new job, you've met someone new or you've decided to move. During these times, you may want to modify the custody, child support or spousal maintenance terms of your original divorce decree. But you cannot legally relocate on your own initiative without the other parent's consent and/or a court order.
Even if you and your ex-spouse agree to these changes, you should make sure the court recognizes the modification. If your ex stops following the new order, you will be able to enforce it.
If you want to oppose a modification proposed by your ex-spouse, our attorneys can help you make your case to the court. A judge will be looking for substantial changes in circumstances, such as moving or changing jobs, as well as the best interests of the children.
Jacob & Fritsch, P.C. can help with modifications to any of the following:
- Primary custodial responsibility
- Child support, including support for disabled adult children
